Refund Policy
HMIA refund policy observes the principles outlined in the ESOS (Education Services For Overseas Students) ACT 2000.
Refunds when HMIA defaults on providing training
Please note that Government Legislation requires tuition fees and application fees to be refunded in full if:
-
The course does not start on the agreed starting date, which is notified in the offer letter.
-
The course stops being provided after it starts and before it is completed, or
-
The course is not provided fully to the student because the college has a sanction imposed by the government regulator.
-
Initial visa refused before course commencement date. A request for refund in writing and proof of visa refusal, from the Australian Government must be sent to the Institute no later than four weeks after visa refusal.
Full refunds will be made within 14 days of the date of any of the above three events and will be accompanied by a written statement explaining how the refund has been calculated. HMIA may arrange for another course, or part of a course, to be provided to students at no cost to the student as an alternative to refunding course money. If students agree to accept this alternative arrangement, HMIA is no longer liable to refund the money owed for the original enrolment.
Student Default
Student default occurs when provider refuses to provide or continue or continue providing a course to the student due to:
- The student failed to pay an amount he or she was liable to pay the provider, directly or indirectly, in order to undertake the course
- The student breached a condition of his or her student visa
- Misbehaviour by the student
In the event a student defaults no refund will be issued to a student either before or after the commencement of course.
In the event the student cancels their enrolment in the course the following procedures are to be applied:
1. 0 Cancellation before course commencement
1.1 In the event student request a refund in writing and received by HMIA 28 days or more prior to semester commencement a refund of 90% of monies paid for tuition fees less $200 administration fees will be issued to the student.
1.2 In the event student request a refund in writing and received by HMIA less than 28 days prior to semester commencement a refund of 75% of monies paid for tuition fees will be issued to the student.
1.3 The refund will be processed within 28 days of the written request being received.
1.4 The refund will be accompanied by a statement outlining total refunded amount.
2.0 Cancellation after course commencement date
2.1 In the event student request a refund in writing and received by HMIA on the commencement date or after the semester commenced, there will be no refund of current semester tuition fees.
2.2 In the event the student requests a refund after commencement date of the course no refund will be issued which includes all monies paid to HMIA for Overseas Student Health Cover, airport pickup, accommodation booking and board. The balance of fees due will be invoiced.
2.3 Refunds for any monies received by the Institute on behalf of the student for services other than tuition fees must be requested from the companies delivering the services such as Overseas Student Health Cover, and students will be subject to the respective companies' refund policies.
Please note that HMIA refund policy and procedures does not remove student right to take further action under Australian Consumer Protection laws or to pursue other legal remedies. Students who believe they have been charged incorrect fee or given an incorrect refund are entitled to dispute the decision using the HMIA Complaints and Appeals procedure. The HMIA Complaints and Appeals procedure does not circumscribe a student’s right to pursue other legal remedies.
